Code on github is open source, so copying is supposed to and expected to occur. The copyrights of the various projects on github are held by their respective authors, not by the US government. These authors have chosen to permit and encourage copying of their code.
Many of these authors are not even American citizens or residents.
Not all of it. A lot of code is uploaded without specifying a license, in which case the only granted rights are those required by the github terms of service. I don't remember the details, but think the ToS mainly allowed downloads and forking on github.
