Moral or legal culpability is not a zero sum game. Recklessness by the pedestrian does not absolve Uber. Generally, if it's in your power to avoid killing someone, you have an obligation to do it. That's also why comparisons to a hypothetical human driver are beside the point. Uber should be judged according to what they could have done to minimize danger, not according to what a human driver would have done.
